New e-cigarette restrictions are a breath of fresh air

E-CigsE-cigarette (e-cig) smoking, commonly known as “vaping,” is not permitted in areas of San Marcos where smoking is currently prohibited.

This change adds e-liquids, smoke juices and cartomizers to the list of smoking-related products that cannot be used in public places of employment, except in designated areas. Similarly, store owners must keep devices out of the reach of customers the same as conventional cigarettes to help minimize youth access to e-cigs and smoking-related products.

Individuals or businesses found in violation of the updated laws may result in a code citation with fines starting at $100.

In narrowing the places where e-cigarettes can be used, San Marcos joins its neighboring North County cities including Carlsbad, Encinitas, Oceanside, Poway, Solana Beach, Del Mar and Vista who have enacted similar measures.

While studies are still inconclusive about the health effects of e-cigs, the change is intended to protect people from inhaling unwanted secondhand vapor that is released from e-cig devices. Treating e-cigs like cigarettes also makes it easier for law enforcement to enforce existing smoking laws since some of the electronic devices look like conventional cigarettes.

By creating smoke-free areas throughout the San Marcos community, the rule change demonstrates the City’s commitment to improving the health, safety and well-being for residents.
